Child Support and Custody Modifications
After a family law case has been completed and a Final Judgment has been entered, the case is closed. However, a judgment may be amended at a later date if an unanticipated and substantial change of circumstances makes modification appropriate and in the best interest of the children. Such a change may be the loss of a job and/or reduction in income of a parent, or an increase or decrease in the amount of time a child spends with each parent.
The burden of proof in an action for modification is high, and the issues are often extremely contested. Your chance of success depends on the experience and expertise of your attorney as well as the facts of your case.
At the Law Office of Amy L. Beauchaine, our Orlando, Florida law firm provides clients with tailored representation in a wide range of family law cases, including modification of existing orders or judgments. With over 18 years of experience, attorney Amy L. Beauchaine is a knowledgeable advocate for clients. She takes all the time necessary to review their entire cases and situations before making a recommendation as to how to move forward with the case.
In addition to child support and custody modifications, we also represent clients seeking modification of alimony/spousal support orders.
Relocation
One common reason for seeking modification of a Final Judgment is the desire of a parent to relocate. Florida has very specific procedures regarding relocation when the relocation will affect children's contact with the other parent. Failure to understand and comply with the strict requirements of the relocation statute may result in the court denying a parent's request to relocate.
We can help you deal with relocation issues, including advice regarding the changes in the Florida relocation statute which go into effect on October 1, 2009.
